    Pendens is a Latin term meaning "suit pending". The term can refer to any pending lawsuit, but in today's legal climate, it is used to indicate that a lawsuit has been filed concerning real estate. In the case of a homeowner delinquent with mortgage payments, the lender will file a Notice of Lis Pendens in the county recorder's or clerk's office. This becomes the official notice that begins the foreclosure process.

    The amount of time from when a Lis Pendens is filed to when the property is actually sold at an auction differs greatly from state to state. The borrower will be served with notice of the lawsuit and will be given the option to appear in court and defend their rights.
